Penalty Points & Disqualification Legal Advice

Careless Driving| Dangerous Driving| Drink Driving| Driving without Insurance| Speeding Offences| Penalty Points & Disqualification

Certain motoring offences can result in your driving licence being endorsed with penalty points. Penalty points remain valid for thee years from the date of conviction, but remain on the licence for four years (eleven years for alcohol or drug related driving offences).

Although the courts are given limited powers not to disqualify in exceptional circumstances, if twelve or more points are accumulated within any three-year rolling period the driver will be disqualified. After disqualification under the totting-up procedure the existing points, will be removed from your licence but your licence will refer to the disqualification for four years (eleven years for alcohol or drug related driving offences).

If you are disqualified for one or more alcohol related offences, the Driver and Vehicle Licensing Agency (DVLA) will carry out medical enquiries before a new licence is granted. These related offences are:

  • Disqualified with a blood level over 200mg/100ml (or equivalent in breath or urine).
  • Disqualified twice in ten years for certain alcohol related offences.
  • Disqualified for failing or refusing to give a specimen.

A form to apply for removal of penalty points can be collected at a Post Office after four years have elapsed. This, in effect, allows you to apply for a 'clean' driving licence.
